Terms & Conditions

By using this site or commissioning a HIPs on the house Home Information Pack, you agree to be bound by the following terms and conditions. These terms and conditions may be changed without notice in the future.

1. About HIPs on the house
HIPs on the house is owned and operated by Whitehead Monckton. VAT Registration Number: 202 9693 64. Registered Office: Monckton House, 72 King Street, Maidstone, Kent, ME14 1BL.

2. Services on the HIPs on the house website
Whitehead Monckton reserves the right to revise or withdraw any of the services provided by us without notice.

3. Commissioning a Home Information Pack (HIP)
An offer for the commission of a Home Information Pack can be made on our website, via email or over the telephone. A binding contract to supply a Home Information Pack will be formed upon payment of the relevant fees and work on the compilation of the Home Information Pack has commenced. The right to commission a Home Information Pack is only available to clients of Whitehead Monckton's residential conveyancing department and we reserve the right to refuse to provide the services to any other person.

4. Price and payment
An estimated price of our residential conveyancing services will be confirmed to you in writing. Payment may be made over the telephone or by forwarding cleared funds to our registered address.

Whitehead Monckton reserves the right to charge interest on unpaid invoices at 5% over the base rate for each month the invoice remains unpaid.

5. Rights of cancellation
Prior to works beginning on the compilation of the Home Information Pack, you can withdraw the offer for us to compile the Home Information Pack, subject to an administration fee. After work has commenced, cancellations will be possible upon payment of an admin fee and payment of all third party costs incurred by us in conjunction with the commissioned Home Information Pack. Cancellations must be made in writing via email. Whitehead Monckton reserves the right to refuse to accept or suspend an order for the compilation of a Home Information Pack if it believes that it would not be reasonable to accept the order or continue compiling the Home Information Pack. The reason for the cancellation/suspension will be communicated in writing within 48hours.

6. Leasehold/commonhold information
You may incur additional costs in obtaining information to send to us for our inclusion in the Home Information Pack. An example of such costs might be landlords or managing agents charges' for providing statements of accounts for the last three years in relation to service charges and other leasehold information. Another example of such costs might be a managing agent's charges for providing copies of requests for payment in respect of commonhold assignment. Any such costs are not included in our charges. Whitehead Monckton cannot be held liable for the loss of the documents sent to us for inclusion. We recommend that copies are made of the documents prior to sending.

7. Accuracy of the information provided by you
The information you provide us will form part of the Home Information Pack. The Home Information Pack will be relied upon by third parties. You must ensure that all the information provided by you is factual, correct, accurate, complete and valid.

8. Accuracy of information obtained from third parties
Included in a Home Information Pack are documents that will be obtained from third parties. Whitehead Monckton shall use all reasonable endeavours to obtain any such documents from suitably qualified and experienced third parties whom it believes to have the relevant degree of expertise and appropriate professional standing. Whitehead Monckton cannot be held liable for any errors/omissions in any such document or any delays caused as a result of late receipt of the documents.

No oral advice or written information provided or published on the website by Whitehead Monckton or its employees will create a warranty. Nor may users rely on any such information for advice. Whitehead Monckton and its partners and suppliers will not be liable for any cost or damage arising either directly or indirectly from any transaction or use of the service.

Whitehead Monckton shall not be responsible for any loss of data resulting from delays, corruption of data, non deliveries, misdeliveries or service interruptions.

Notwithstanding anything to the contrary in this agreement, Whitehead Monckton's maximum liability under this agreement for all damages, losses, costs and causes of actions from any and all claims (whether in contract, tort, including negligence, quasi-contract, statutory or otherwise) shall not exceed the actual pound sterling amount paid by the customer for the services which gave rise to such damages, losses and causes of actions during the 3 month period prior to the date the damage or loss occurred or the cause of action arose.

In no event will Whitehead Monckton be liable or responsible to users of the service for any type of incidental, punitive, direct, indirect or consequential damages, including but not limited to, loss of revenue, lost profits, replacement goods, loss of technology, rights or services, loss of data, or interruption or loss of use of service or equipment, even if advised of the possibility of such damages, whether arising under theory of contract, tort (including negligence), product liability, strict liability or otherwise.

9. Intellectual property rights
All intellectual property rights pertaining to this website and in our Home Information Packs belong to Whitehead Monckton.

10. Transfer of rights and obligations
You may not transfer, assign, charge or otherwise dispose of a contract, or any of your rights or obligations arising under it, or any Home Information Pack, without our prior written consent. We may transfer, assign, charge, sub-contract or otherwise dispose of a contract, or any of our rights or obligations arising under it, at any time during the term of the contract. Only the parties to a contract may seek to enforce its terms.

11. Events outside our control
Whitehead Monckton will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract caused by events outside our reasonable control.

12. Law and jurisdiction
These terms and conditions and any contracts entered into through this site will be governed by English law and subject to the non exclusive jurisdiction of the English courts.
